BUSINESS: Ellen went over her research on the open meeting laws. She explained that there are certain pieces of information on applications that would require us to go into an executive session to discuss. The Board agreed that if they needed to discuss an application in an executive session they would reconvene an open meeting before taking a vote. The Board also decided that an updated Record of Abatement would be attached to the meeting minutes during the abatement period.
Harald and Patrice updated the Board on the sales inspections. Patrice reported that the 2nd mailing went out to the residents who did not respond. Harald informed the Board that Bruce would also use the Multiple Listing Service (MLS) for sales data. Harald informed the Board that the Department of Revenue (DOR) representative called to set up a meeting.
Harald explained to the Board that the DOR is requiring us to develop a cost basis for our building values either from an independent study or with a provider of building cost data like Marshall and Swift. Harald also informed the Board that the state will be looking closely at commercial land this recertification.
Jay Hersh questioned some of Ellen’s findings on the Open Meeting Laws and abatements. Our current understanding is that only information which is private under the Privacy Law must be protected.
Mr. Hersh asked whether there is documentation of the Patriot model which explains how values are calculated. The Board and Harald explained that Patriot does not provide this.
The meeting was adjourned at 9:30am.
