Previous Minutes The minutes from the November 13, 2002 meeting were approved as written.
Septic System Review:
21 Hillside Road The petitioner is asking the Board to grant two variances from its local regulation:
1) To construct a leaching facility with 6 inches of base aggregate below the distribution pipes, instead
of 12 inches as required by local amendment to 310 CMR 15.247(3).
2) To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
After a brief discussion with Bill Murphy, R.S., the designer of the system, a motion was made to grant the local variances as requested. The motion passed 3-0.
16 Browning Lane Charles Freed came before the Board to modify or withdraw a letter written by staff on November 10, 2002. Mr. Freed had a Title V done on his property even though he is not planning to sell his house. Because there was a dry well only 44 feet away from a drinking well instead of at least 50 feet, the Title V was failed. The dry well receives only gray water from a kitchen sink. Mr. Freed has had the well tested and there appears to be no contamination from the dry well. The Board did not consider this to be a health hazard but felt that any future buyers should be made aware of the situation. Mike Moore will write an opinion for the Board, which will then be attached to the failed Title V. The opinion will cover only gray water and will request that
no bathroom facilities be added to the dry well. At that point, the property will be in full compliance of the law and buyers will be made aware of the situation.
Other Business:
Bills Paid 2 bills were paid: Town of Lexington in the amount of $356.07 for the October hazardous waste collection and the Lincoln Police Department in the amount of $144.20 for a police detail during the flu clinic on November 16.
Flu Clinic Approximately 165 residents came to Bemis Hall on November 16, 2002 for the flu clinic. Dr. Weinberg mentioned that there have been 5 cases of influenza A reported in the State. There have been many cases of the Norwalk virus, which has hit nursing homes badly.
Town Report The Board reviewed the report written by Mike Moore to be included in the annual town report and the final report will be submitted to Chris Coleman.
Proposed Changes to Title V Mike Moore brought in several letters written to the State voicing their disapproval of the proposed changes to Title V, which would allow 60 minute per inch perc rates. Mike Moore will also write a letter on behalf of the Board stating their concerns, but he also mentioned that the local Board could institute their own more stringent local regulations, which could keep the perc rate as it is.
Tobacco Control Mike Moore also informed the Board that the Mass. Dept. of Public Health had ceased funding on November 30, 2002 for tobacco control activities.
