Meeting Minutes
March 5, 2003

Previous Minutes  The minutes from the February 5, 2003 meeting were approved as written.  

Septic System Review:
4 Hawk Hill Road  The system designer reports that this system “failed Title 5 inspection” and proposes to add a second septic tank and a new d-box and leaching bed.  Even with the requested variances, there will be a leaching mound, which is 2.5 feet high on the lower end.  The petitioner is asking the Board to grant two variances from its local regulations:

1)    To construct a leaching facility with 6 inches of base aggregate below the distribution pipes, instead
                     of 12 inches as required by local amendment to 310 CMR 15.247(3).
2)      To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).

Bob Guernsey, system designer, presented his plan for the new system.  Abutters, Pat and Janice Phillips, Paul Travers and Turid Horgen voiced their concerns regarding the flow of ground water and runoff and wanted to know why the system was not kept in the same area.  Mr. Guernsey said that there was not enough room to put it where it was because Title 5 requires a bigger bed than the original one.  Mr. Phillips felt that there were ground water issues and requested that the Board see what the impact is with a plan that meets code.  Ms. Horgen offered to design a plan, which she felt would be more appropriate.  Mr. Guernsey felt that he had spent a long time on this plan and this was the best solution and said that he would need to use a trench, which would mean a higher mound and possibly the taking down of more trees.  Mr. Travers, the closest abutter to the proposed leaching bed, stated that he did not want a system, which is higher and closer to his property and is in favor of the variances.  Dr. Mansfield told the abutters that the Board tries to be reasonable and flexible so as not to cause undo hardship on the homeowner.  The Board voted 3-0 to have Bob Guernsey return at the next meeting with another drawing, which will show a trench with 1 foot of stone to code.   

18 Old Sudbury Road  According to the system designer, Bob Guernsey, the cesspool, which currently serves this property is failed.  The proposed replacement system is located as far as possible away from wetlands, but will still require variances from the 100-foot setback requirement.  The petitioner is asking the Board to grant four variances from its local regulation, and two local upgrade approvals from Title 5:

1)      To construct a leaching facility 5 feet from the front property line, instead of 10 feet as required by 310 CMR 15.211(1).
2)      To construct a leaching facility 10 feet from a cellar wall, instead of 20 feet as required by 310 CMR 15.211(1).
3)      To construct a leaching facility with 6 inches of base aggregate below the distribution pipes, instead of 12 inches as required by local amendment to 310 CMR 15.247(3).
4)      To construct the following components less than 100 feet away from wetlands, which is prohibited by local amendment to 310 CMR 15.211(1):
a)      Leaching facility is 66 feet away and
b)      Septic tank is 58 feet away.
5)      To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
Bob Guernsey said that the land is very swampy, that there is a large oak tree almost on the road and that they will need to drive over the bed to get to their parking area..  He also said that they might move the driveway but that the system will need to handle being driven over.  After a brief discussion and with no other alternatives, a motion was made to grant the local variances and upgrades as requested.  The motion passed 3-0.  The owners still need to go before the Conservation Commission.   

Lot 6 Storey Drive  This was an informal discussion with Stanly Black, owner,  and Bruce Ey, Schofield Brothers, designer, regarding their options for a septic system on Mr. Blacks property after receiving confirmation from DEP that the intermittent stream on his property that discharges to a tributary to a surface water supply, is itself a tributary to a surface water supply.   Mr. Ey showed the Board revised plans showing a new septic system, which is a triangular pressure dose system wedged into the lot corner but said that he was a little uncomfortable with this system.  He said that it would require removing much of the screening from the side and front lot lines and will still need local and Title 5 variances.  Mike Moore said that it was a very creative and complicated system and he has never seen a system with different length trenches.  The decision made was to come back to the Board with the original plan, which would place the septic tank 145 feet from the stream and the leaching field 154 feet from the stream.  They will return to the Board on April 9 and Mike Moore with send out certified letters to the abutters informing them of the meeting.  Mr. Ey will make up a packet, which will include a plan showing what is proposed and Mike will inform abutters that a plan will be available for viewing in the Building Department prior to the April 9 meeting.  

Message Therapy License:
Christopher Real of 21 Bedford Lane came before the Board to be granted a license to practice massage therapy in the Town.  He would be practicing out of his home and would be seeing an average of 1 or 2 clients a day.  After a brief discussion, the Board voted 3-0 to grant Mr. Real a permit to practice massage therapy.

Other Business:
Jet Fuel Residue  Mike Moore said that he has not yet gotten the names of laboratories in the area that could test residue but would hopefully have something by next meeting.
Flu Vaccine  Mike Moore informed the Board that the Department of Public Health would not be providing flu vaccine to the towns next year and that the Council on Aging should be made aware of this fact so that they can inform the public and perhaps make other arrangements.  Elaine Carroll said that she would inform Karen Santucci.
Rabies Clinic  The Board was informed that the 2003 rabies clinic would be held on Saturday, April 5, from 9:00  11:00 a.m. for dogs and 10:00  11:00 a.m. for cats and will cost $10.00 per injection.  Dr. Betsy Johnson will be here to administer the shots.  A notice will be placed in the Lincoln Journal for several weeks before the clinic date.
118 Lexington Road  The members were given a letter from the Conservation Commission regarding the variances, which the Board granted in June of 2002.  
Tobacco Control Regulation  The Board will be distributing copies of the local tobacco control regulation to all department heads, which was prompted by a complaint from a town employee of someone smoking in a town-owned structure.
