Meeting Minutes
November 12, 2003

The minutes from the October 1 meeting were approved with one correction, which will be made.

School Dept. Business:
Karen Lewis, the new school nurse, came in to meet with the Board.  She will be present at the flu clinic on Saturday.

The Food Service Directors were asked by members of the School Committee to request permission to put a salad bar over at the Brooks facility.  The members talked this over with Mike Moore and concurred with his decision that there was not enough area for a salad bar.  The directors were notified of this decision.

The members discussed the situation of the septic system at the schools and a letter from DEP, which was written back in 2000.  It was felt that nothing needed to be done at this time but if any additions were planned in the future to the schools, a new septic system would need to be one of the costs added to any project.

Septic System Review:
6 Stonehedge  According to the designer, increasing the size of the leaching facility to accommodate a garbage grinder would result in additional fill material within the 100-foot setback from wetlands.  The petitioner is asking the Board to grant one variance from its local regulations to avoid doing this:

1)   To construct a leaching facility which is not increased by 50% to provide for potential garbage
grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).

After a brief discussion with designer, M. J. DeModica, a motion was made to grant the local variance as requested provided that a deed restriction is filed, which prohibits the installation of a garbage grinder.  The motion passed 2-0.  The petitioner provided the Board with a copy of a deed restriction, which has already been filed.  

22 Warbler Springs Road  When this application was received, it was noted that a waiver would be needed for the setback issue.  Later when the plan was reviewed in detail, it was rejected for additional problems and a letter was written to Windriver Environmental addressing these 9 problems.  The petitioner is asking the Board to grant one variance from its local regulation:

1)      To construct a leaching facility, which is 10 feet away from a cellar wall, instead of 20 feet as required by 310 CMR 15.211(1).

After a brief discussion, at which time Ted Doucette, P. E., Windriver Environmental addressed the 9 problems.  Mike Moore went over each problem with the plan and will go over the plan in greater detail after the meeting.  John Aquino, Bankruptcy Trustee for the property, said that they are prepared to go to closing as soon as possible and they would get a quote for the cost of the system and the buyer would be responsible for putting in the system with a reduction in the cost of buying the house by the cost of replacing the system.  A deed restriction limiting this to a 7-bedroom house will be included in the new deed.  A motion was made to grant the local variance as requested assuming that Mike has no problem with the new plan.  The permit for installing the system will state that the system cannot be used until a Certificate of Compliance is issued and no Certificate will be issued until Mike receives the new deed with the 7-bedroom restriction in it.  The motion passed 2-0.



3 Deer Run Road  The petitioner is asking the Board to grant two variances from its local regulations:

1)      To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
2)      To construct a leaching facility with 6 inches of base aggregate below the distribution pipes instead of 12 inches as required by local amendment to 310 CMR 15.247(3).

After a brief discussion with David Schofield, R.S., which included a discussion on infiltrator systems, a motion was made to grant the local variances as requested.  The motion passed 2-0.

37A Baker Farm   The petitioner is asking the Board to grant one variance from its local regulation:

1)      To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
 
After a brief discussion with David Schofield, R.S., and Ramelle Adams, owner, which also included a discussion on infiltrator systems, a motion was made to grant the local variance as requested.  The motion passed 2-0.

Other Business:
Flu Clinic  The Council on Aging flu clinic will be held Saturday, Nov. 15 in the Donaldson Room and the Board members and Karen Lewis, school nurse, will be administering the shots from 9:00 a.m. to 11:00 a.m.
Bills Paid  Town of Lexington for Hazardous Waste Collection for Sept. and Oct. - $1,287.83 and Moore Medical for supplies needed for the flu clinic - $73.36.
FY 05 Budget  The members reviewed the FY 05 budget and approved of the cutbacks which were made.

There being no further business, the meeting was adjourned at 9:00 p.m.  The next meeting will be held on December 10, 2003.
