Meeting Minutes
February 4, 2004

The minutes from the December 10 meeting were approved as written.  After going over the calendar of upcoming meetings, Diane Haessler said that she would be unable to attend the March 10 meeting and Elaine Carroll said that she would check with Dr. Weinberg to be sure that he would be able to attend that night otherwise the meeting would be moved back to March 3.

Septic System Review:
207 Concord Road  The petitioner is asking the Board to grant one local variance:

1)      To construct a leaching facility, which is not increased by 50% to provide for a potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).

After a brief discussion with designer, M. J. DiModica, at which time he explained that the reason for the variance is to keep the leaching field away from a walkway to prevent water buildup into the walkway.  The old system failed Title 5 and to save some trees or not have to dig up the driveway area, this is the best spot for the leaching field.  A motion was made to grant the local variance as requested, provided that the owner files a deed restriction that prohibits the installation of a garbage grinder.  The motion passed 2-0.    

39 North Great Road  This property is a vacant parcel, which is located in the Zone 2 of one of Bedfords public water supply wells.  Since the septic system will serve new construction, Section 310 CMR 15.214 of Title 5 restricts the release of nitrogen to 440 gallons per day per acre.  The applicant proposes to construct a new 5-bedroom house on a 48,901 sq. ft. parcel.  This would result in a nitrogen load of 491 gallons per day per acre (550 gpd/1.12 acres), which exceeds the 440 gpd/acre restriction set by 310 CMR 15.214.  The petitioner is asking the Board to approve a nitrogen-loading aggregation plan that links an abutting 1,320 sq. ft. parcel with the existing 48,901 sq. ft. parcel for a total of 50,221 sq. ft.  This request would require the Board to grant its written approval under 310 CMR 15.216(2)(b).  The Boards written approval would then be part of the DEP application that the petitioner would have to file with DEP.  If DEP approves the application, then the Lincoln Board of Health can issue a permit to construct the system.  After a brief discussion with the owner, Tim Shea, and the designer, Bob Guernsey, and reviewing a Title 5 Nitrogen Loading Restriction and Easement document draft drawn up by Mr. Sheas attorney, a motion was made to grant the approval with stipulation to be added to septic permit and Certificate of Compliance that the 1,320 sq. ft. parcel of land shall not be paved, widened or changed without first going back to the Board of Health for review and approval.  The motion passed 2-0.  Mike Moore will draft a letter to Tim Shea who will have his lawyer send in to DEP who will have 60 days to respond.  DEP will send a copy of their decision to Mike and if approval is granted, he will then be able to grant a permit for the septic system.

Food Establishments:
Codman Community Farms  Don Frankel, Stewart Young, Bill Huss and Linda Miner came before the members to request a waiver of conditions from the Board so that Codman Community Farms may prepare and serve food at Town Meeting on March 27th and lunch and snack on March 28th at Codman Community Farms.  CCF has been serving lunch at the Town Meeting  (typically 200 services) for the past 10-12 years and the following day served visitors (typically 100 services) at the Annual March Sheep Shearing, which is held at the farm.  CCF was informed last August that the CCF kitchen is not “in compliance” with Board of Health regulations and, therefore, is requesting a waiver.  The menu for both events is hot soup, vegetarian chili, ham and cheese sandwiches and bottled water.  Mike Moore said that the kitchen at Codman may not be adequate for preparing mass amounts of food, there is evidence that cats roam around the kitchen and chicken eggs are washed off in the only sink in the kitchen.  CCF also said that hams would be cooked in volunteers homes, which Mike said would not be acceptable.  He suggested that it would be better to have ham bought all sliced, which would eliminate two steps of possible contamination or even better would be to have the sandwiches pre-made and pre-packaged.  Mike also said that using a commercial kitchen such as St. Annes or First Parish would be much better.  Mike said that it would be best to have one person which is Harriette Adamson, who is a licensed food manager, go over everything with Gabby White, Public Health Inspector.  They will go over all the conditions and if an agreement cannot be made over the next month, CCF may need to come before the Board again next month with any variance requests.  Any major problems will be discovered beforehand and worked on.

Other Business:
118 Lexington Road  Mike Moore showed the Board a new plan for the sub-division at 118 Lexington Road and informed the Board that since these lots have been reconfigured since they last came before the Board for septic approvals, they would need to come before the Board again for any variances requested and would need to submit new septic plans
Lincoln Mall Expansion  Mike informed the Board that the proposed expansion of the Lincoln Mall could result in the DEP requesting Lincoln Woods to come up with a 20-year plan for their treatment plant.  
Concord Services  Mike told the Board that he had written a memo to Tim Higgins telling him that because of a decline in staff support provided to Lincoln by Concord, there is a surplus of hours available to Lincoln under the 700-hour a year limit.  Because of this, he suggested that Stan Sosnicki spend some time in Lincoln meeting with residents who may have questions, attending the Land Use Group meetings, doing Title 5 reviews, etc.  The members thought that this would be a good idea and gave their approval.  Mike will keep track of the time used to be sure that the increase is not out of line.  Elaine Carroll will inform Tim Higgins of the Boards decision.
Rabies Clinic  The Rabies Clinic will be held on Saturday, April 3 from 9  10 am behind the Town Office Building.  Elaine Carroll will post notices around Town, publish it in the Lincoln Journal a week before and has already posted it on the website.
Bills Paid  East Middlesex Mosquito Control Project - $2,500.00 (second payment) and Town of Lexington, Nov. Hazardous Waste Collection - $1,098.81.

There being no further business, the meeting was adjourned at 9:20 p.m.  The next meeting will be held on March 10, 2004.
