Meeting Minutes
June 2, 2004

The minutes from the May 12 meeting were approved as written.  The next meeting will be in late July or early August.

Massage Therapy License:
Colleen Carney before the members to request a license to practice massage therapy at 189 Tower Road in a studio on the property, which will function nicely as a massage treatment room.  Ms. Carney has been practicing for 13 years and has a business in Everett, which she will still operate and work between both locations.  There is adequate parking on site and she expects to have one-hour appointments for each client.  She deals mainly in auto accidents and insurance claims.  The Board voted 3-0 to grant Ms. Carney a permit to practice massage therapy in Lincoln.  Mike Moore will contact the references Ms. Carney supplied and then send her a license.  The members felt that even written references should be checked by a phone call to verify their accuracy.  

Septic System Review:
16 Old Cambridge Turnpike  According to applications filed with the proposed plan, the existing system is no longer functioning.  High ground water was measured 2 feet below the surface, and the alternative technology (Singulair) proposed instead of a septic tank will allow the bottom of the leaching area to be 2 feet above ground water.  In spite of the decreased separation from ground water, there will be a leaching mound, and a 6-inch deep bed is proposed to limit the amount of fill.  The petitioner is asking the Board to grant 3 variances from the local regulation and one local upgrade from Title 5:

1)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).
2)      To construct a leaching facility with 6 inches of base aggregate, instead of 12 inches as required by local amendment to 310 CMR 15.247.
3)      To construct a leaching bed or field, which is not allowed by local amendment to 310 CMR 15.252(1).
4)      To construct a leaching facility 5 feet away from an impermeable barrier, instead of 10 feet as recommended by 310 CMR 15.255(2)(g).

Martha Minnick, the owner, came before the members.  Mike Moore said that without the alternative system the mound would be 2 feet higher.  After a brief discussion, a motion was made to grant the local variances as requested provided that a deed restriction is filed, which prohibits the installation of a garbage grinder.  The motion passed 3-0.

30 Sunnyside Lane  The existing system is in failure and breaking out.  The proposed system is further from the wetlands and has a greater separation from ground water.  The petitioner is asking the Board to grant 5 variances from its local regulations:
1)      To construct system components less than 100 feet away from wetlands, which is prohibited by local amendment to 310 CMR 15.211(1):
(a)     Leaching facility is 60 feet away,
(b)     Pump chamber is 88 feet away, and
(c)     Septic tank is 93 feet away.


2)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).
3)      To construct a leaching bed, instead of trenches as required by local amendment to 310 CMR 15.252(1).

Mike Moore represented the petitioner, which is the Town of Lincoln.  The house is used for Section 8 housing and in the future there should be an accessory apartment added, which will be used as affordable housing and may be handicapped accessible.  The original plan done by Bob Guernsey would have placed the septic tank in the wetlands.  Stan Sosnicki of the Concord Board of Health redesigned a new plan, which moved the tank closer to the house and further from the wetlands.  After a brief discussion, a motion was made to grant the local variances as requested provided that the Housing Commission makes it a condition of any lease agreement that no garbage grinder be installed.  The motion passed 3-0.

Other Business:
New Local Regulations  Mike Moore gave the members a draft of the new local septic regulations and discussed several modifications, which will be made to the original draft.  Mike asked Elaine Carroll to give copies of the draft and the original local regulations to Mark Whitehead, Town Planner, and Tom Gumbart of the Conservation Dept.  After the other departments have given their input, Mike will publish the necessary notices in the local paper to begin the process of adopting the new local regulations.
Bio-terrorism  Mike Moore gave the duffle bag filled with materials supplied to all the towns from the State under the Regional Emergency Preparedness Coalition Funding to the Fire Department for safekeeping.  He also said that he had applied to the MDPH for the $1,965 allotted to Lincoln and will be used for a Dell A960 fax/printer for the school nurse to use and also 2 portable Honda generators, which will provide the Board of Health with resources needed to manage large quantities of vaccine during power outages.  These generators will be stored at the Fire Department.   He will keep the members informed as to whether these requests are granted.  
Bills Paid  One bill was paid to Eliot Community Human Services in the amount of $1,250.00.
