Meeting Minutes
December 8, 2004

The minutes from the Nov. 3 meeting were approved as written.  The next meeting will be January 5, 2005.

Flu Clinic  The members met with Maureen Richichi, the school nurse, who said she used 144 doses of the flu vaccine and the members must decide what should be done with the extra doses.  Mike Moore said that there would be a flu clinic in Lexington on Dec. 9 and one in Concord on Dec. 16 and that the unused flu vaccine could be given to Emerson for their flu clinic, which is what the members voted to do.  Maureen will notify the CDC of the usage for Lincoln and give the remaining doses to Emerson.  

Massage Therapy License:
Paula Lazaroff of Fairhaven, Mass. came before the members for a massage therapy license.  She would be working with Sara Panarello who practices in Lincoln.  After a brief discussion, the members voted 2-0 to grant Ms. Lazaroff a license to practice massage therapy in Lincoln.  Mike Moore will contact her references and then issue the license.

Food Establishments:
WhistleStop  Brian Mehigan came before the members with his contractor, Philip North, and Bill Jackson of Jackson Associates, managers of the Lincoln Mall, to discuss the renovations to be made to the additional space.  There will be one handicapped accessible bathroom available.  Dual bathrooms would be available on first floor whenever the new post office is built.  Mr. Mehigan asked permission to serve breakfast sandwiches.  He would not be using raw eggs but a pre-make egg similar to what is used at Dunkin Donuts and would not require any cooking.  After a brief discussion, the members voted 2-0 to grant a variance for the lack of a ventilation system with sufficient capacity to keep room free of excessive heat, odors, smoke, and fumes, renewal of the food license, which will expire on January 6, 2005 and felt that the present hand sink is not a problem.  The members will require the installation of a mop sink.  Breakfast sandwiches can be served as long as there is no cooking involved and only reheating.  Mike Moore will further study the plan submitted to be sure that things will work according to the food code and the contractor will present a new plan showing the location of the required mop sink.  Mr. Mehigan hoped to get the renovations done by Jan. 6.  Mr. Mehigan addressed the issues of food code violations and also the ones from the latest inspection.  

Donelans  The employee restrooms have been closed to the public in a letter dated Nov. 19, 2004 because of the fact that the general public is allowed to walk through food preparation and storage areas, which violates section
FC2-103.11 (B) of the Food Code.   Mike Moore also sent a letter to Donelans with a list of Food Code violations.  Barbara Reddy, representing Donelans, came before the members to say that renovations would be made in the next 3 to 4 months to bring things up to code.  Mike will review plans from the architect.  The bathroom for employees only will be done over.  They plan on doing extensive cleaning and will be replacing some ceilings, floors and lights and the architect suggested partitioning off one end of the meat room for salad bar preparation.  Barbara Reddy will meet with Gabi to go over suggestions.  They will be putting in new shelving but do not want to do extensive renovations until they find out about the proposed new post office.

Septic System Reviews:
146 Trapelo Road  The proposed location for the leaching facility is located on a slope between several large outcroppings of ledge.  The designer is attempting to save several stone walls and limit the amount of fill material that will have to be added to the downgradient slope.  Designer Wayne Chouinard of The Jillson Company brought in a new plan, which addresses the groundwater issue.  The petitioner is asking the Board to grant 2 variances from its local regulations:

(1)     To construct leaching trenches that are 54 feet long, instead of no more than 50 feet as required by local amendment to 310CMR 15.251(1)(a).
(2)     To construct a leaching mound with a 2:1 downgradient slope, instead of no steeper than 3:1 as required by 310CMR 15.255(2).

After a brief discussion, a motion was made to grant the local variances as requested.  The motion passed 2-0.

11 Juniper Ridge Road  The proposed leaching facility will be located on a hillside that slopes from the street to the house.  The system design includes a Singulair alternative technology that allows the leaching bed to be 2 feet lower.  The petitioner is asking the Board to grant three local variances from its local regulations:

1)      To construct a leaching facility with 6 inches of base aggregate, instead of 12 inches as required by local amendment to 310 CMR 15.247.
2)      To construct a leaching bed, instead of trenches as required by local amendment to
       310 CMR 15.252(1).
3)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).

After a brief discussion with the owners, Richard Anderson and Maria Vet, a motion was made to grant the local variances as requested provided that a deed restriction is filed, which prohibits the installation of a garbage grinder.  The motion passed 2-0.

14 Silver Birch Lane  In February of 2001, the Board of Health granted the previous owner variances to construct a 4-bedroom system on this property.  Michael Baltey, who wants to construct a 5-bedroom system, now owns the house.  Since a 5-bedroom system is larger than what was originally approved by the Board in 2001, the owner was advised that he would have to ask the Board to vote on the new proposal.  This week, Tom Gumbart, Conservation Director, advised the staff that the “tributary to a reservoir” shown on the plan is actually a drainage ditch that is not a stream.  Therefore, Mr. Baltey will not have to obtain variances for setbacks to a tributary to a surface water supply.  The petitioner is asking the Board to grant two variances from its local regulations:

1)      To construct a leaching facility with 6 inches of base aggregate below the distribution pipes, instead of 12 inches as required by local amendment to 310 CMR 15.247(3).
2)      To construct a leaching bed or field, instead of trenches as required by local amendment to  
310 CMR 15.252(1).

After a brief discussion with Michael Baltey, a motion was made to grant the local variances as requested.  The motion passed 2-0.

Other Business:
Food Code  Mike Moore brought in a form, which will be given to all the facilities with kitchens for public use.  The form will be filled out before events and will include what is necessary for these proposed events.  
Bill Paid  Four bills were paid:  Town of Lexington for Hazardous Waste Collection in Sept. for $514.37, Moore Medical for flu clinic supplies for $64.29, Lincoln Police Dept. for police detail for flu clinic for $153.00 and Eliot Community Human Services for $1,250.00 (first quarter).
Annual Report  Mike Moore will again write the annual report to go into the Town Report and asked Elaine Carroll to provide him with a list of reported communicable diseases for 2004.
Natural Resources Committee  Elaine informed the members that the Selectmen are still looking for a representative from the Board of Health to join the new Natural Resources Committee.  Dr. Mansfield asked Elaine to find out what the schedule of meetings would be and get back to him.
