Meeting Minutes
January 5, 2005

The minutes from the Dec. 8, 2004 meeting were approved as written.  The next meeting will be February 2, 2005.

Food Establishment:
WhistleStop Gourmet  Mike Moore reported that the renovations to the WhistleStop are progressing nicely.  They have installed a mop sink in accordance with code regulations and have gutted out the duct work to allow for a ventilation system in the ceiling.  The Board voted 2-0 to grant Brian Mehigan an additional one-month permit to operate, which will expire on February 3, 2005.

Septic System Reviews:
63 Winter Street  A site visit conducted on 12/30/04 showed a stream along the western property line, which was not shown on the original plan by Schofield Engineering.  Tom Gumbart was asked whether or not this stream is a wetland resource.  Charlie Stankard, Jr. brought in a revised plan dated 1/5/05 showing the wetlands buffer zone.  The petitioner is asking the Board to grant 6 variances from its local regulations and 2 local upgrade approvals:

1)      To construct a leaching facility with 6 inches of base aggregate, instead of 12 inches as required by local amendment to 310 CMR 15.247.
2)      To construct a leaching bed, instead of trenches as required by local amendment to
       310 CMR 15.252(1).
3)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).
4)      To construct system components less than 100 feet away from wetlands, which is prohibited by local amendment to 310 CMR 15.211(1):
a)      Leaching field is 66.4 feet away,
b)      Septic tank is 49.8 feet away, and
c)      Pump chamber is 48.4 feet away.
5)      To construct septic components less than 200 feet away from a tributary to a surface water supply, which is prohibited by 310 CMR 15.211(1).
a)      Leaching field is 116.8 feet away, and
b)      Septic tank is 94.8 feet away.
After a brief discussion, at which time an abutter, Rich Wiggin, voiced no problem with the proposed system, a motion was made to grant the local variances and upgrades as requested provided that a deed restriction is filed, which prohibits the installation of a garbage grinder.  The motion passed 2-0.

26 Morningside Lane  The proposed leaching facility is located in the northwest corner of this property, where there is a small hill.  The proposed “bed” of infiltrators would fit in the hill with a small amount of additional fill material.  The petitioner is asking the Board to grant 2 variances from its local regulation:

1)  To construct a leaching bed, instead of trenches as required by local amendment to
       310 CMR 15.252(1).
2)      To construct a septic tank and pump chamber 47.7 feet away from wetlands, instead of 100 feet as required by local amendment to 310 CMR 15.211(1).

After a brief discussion, a motion was made to grant the local variances as requested.  The motion passed 2-0.

Other Business:
Local Septic Regulations  Mike Moore brought in a draft of the proposed new local septic regulations for the Board to discuss.  Since there seems to be a lot of interest from various boards regarding these proposed regulations, it was decided that Mike Moore would come up with a presentation for the next meeting and then set up a time during the March meeting to meet with other boards so that these boards will have a better understanding of the changes proposed.  The new regulations will then go to town counsel for review.
Tobacco Regulations  Mike Moore also discussed the possibility of removing our local tobacco regulations, which were adopted two years ago and using the Mass. Smoke-free Workplace Law, which was approved by the State on
June 18, 2004.  Mike will compare the two and report back to the Board.
Bill Paid  Two bills were paid:  Town of Lexington for Hazardous Waste Collection in Oct. 16 and 30 for $908.31 and Eliot Community Human Services for $1,250.00 (second quarter).
