Meeting Minutes
December 6, 2006

The minutes from the November 8, 2006 meeting were approved as written.  The next meeting is scheduled for January 3.

Septic System Reviews:

69 Page Road  The Board heard a petition from David Crispin of BSC Group for the following variance from its local regulation:
(1)     To construct the basement or lowest floor of new construction at elevation 248.5, which is approximately 3.6 feet below the maximum groundwater elevation of 251.6 to 252.9; instead of constructing the basement at least 2 feet above groundwater as required by local amendment to 310 CMR 15.212.
The proposed house is new constructions on a vacant lot with ground water approximately 3 feet below the surface.  The proposed leaching facility is in a large mound, which allows the system to be constructed with the 4-foot separation between ground water and the leaching facility as required by Title 5.  However, the house would have to be raised by about 6 feet if a full basement is to be constructed at least 2 feet above groundwater as required by the local regulation.
After reviewing the proposed structure and system, the Board agreed that these waivers would vary to the least degree necessary the requirements of the local regulations so as to allow for both the best feasible design within the borders of the lot, and have the least affect on public health, safety and the environment.  However, the Board also agreed that the permit to construct should not be issued until after the notice of variance is filed with the Registry of Deeds.
Motion to grant the local variance with conditions made, seconded, and passed.

9 Oak Knoll Road  The Board reviewed a request for the following variances from its local regulation:
(1)     To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).
(2)     To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
However, since the property owner and the system designer were not present at the meeting, no action was taken on the request.   Motion to continue hearing to next meeting made, seconded, and passed.

172 Trapelo Road  The Board heard a petition from David Schofield, R.S., for the following local upgrade approval from Title 5 and two variances from its local regulation:
(1)     To construct septic system components 322 feet away from a surface water supply, instead of 400 feet as required by 310 CMR 15.211(1).
(2)     To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2).
(3)     To construct a leaching bed or field, which is prohibited by local amendment to 310 CMR 15.252(1).
Because the lot contains substantial outcroppings of ledge along its eastern property line, and the Boards agent and the owners soil evaluator agreed that the only practicable location to build a leaching facility was in the south eastern corner.  However, this location is less than 400 feet from the Cambridge Reservoir.
After reviewing the proposed structure and system, the Board agreed that these waivers would vary to the least degree necessary the requirements of the local regulations so as to allow for both the best feasible design within the borders of the lot, and have the least affect on public health, safety and the environment.  However, the Board also agreed that the permit to construct should not be issued until a deed restriction that prohibits the installation of a garbage grinder is filed with the Registry of Deeds.
Motion to grant the local variance with conditions made, seconded, and passed.

Other Business:

Retail Food Establishments  Mr. Moore briefed the Board on a proposal to sell raw milk at a local farm, the process being used by a local vendor to slaughter free-range chickens, and a proposal to preserve and can food in a community kitchen.
