Meeting Minutes
March 7, 2007

The minutes from the February 7, 2007 meeting were approved as written.  The next two meetings are scheduled for April 4 and May 2.

Massage Therapy Review:
Carolyn Forman of 8 Oak Meadow came before the members to request a license to practice massage therapy both out of her home and in clients homes in Lincoln.  She said that this would not be full time.  She has 3 parking spaces on her property and a bathroom available for clients to us for changing.  She said that she teaches infant massage to parents by using a doll.  She said that especially first time parents want to know the proper technique.  Mike Moore said that in Concord a massage therapist cannot go to clients homes but it is allowed in Lincoln.  Carolyn said that she hasnt practiced since having children and wants to get back into it.  About 8 years ago, she worked in a spa in California 4 days a week with about 4 clients a day then went into private practice.  After a brief discussion, a motion was made to approve the license to Mrs. Forman.  The motion passed 2-0.

Lincoln Cemetery:
After the hearing notice was placed in the paper and mailed to abutters in accordance with MGL Ch. 114, s. 34, Susan Brooks, Town Clerk, received an email from Anita Scheipers, Assistant Town Administrator, saying that Town Counsel is of the opinion that no Town Meeting or Board of Health vote is needed for the Lincoln Cemetery Commission to add on to the existing cemetery.   Instead of re-mailing abutter notifications and placing a second legal ad in the paper to reverse the first, it was left on the agenda as is, but no action taken.  No one showed up for the hearing and a motion was made to accept the advice of Town Counsel.  The motion passed 2-0.

Lincoln Public Schools  Lunch Program:
The School Dept. is requesting certain variances from the Board to allow food service to continue at the gymnasium at Smith School.  This would give LPS two food service operations: one at Brooks and one at Smith.  The variances for Smith are intended to be a short-term solution until a kitchen like the one at Brooks can be constructed in a storage area near the gym.  Concord staff is still reviewing these plans with LPS and the Board does not need to take a position on the proposed plans at this time.  The petitioner is asking the Board to approve three variances from the Food Code:

1)      Establishment does not have equipment for heating and hot holding potentially hazardous food as required by FC 3-501.16.
2)      Time only, rather than time in conjunction with temperature, is used as the public health control for ready-to-eat potentially hazardous food that is displayed or held for service for immediate consumption as per FC 3-510.19.
3)      Establishment does not have a hand washing facility located to allow convenient use by employees in Smith gymnasium as required by FC 5-204.11.

Buck Creel and Cathleen Higgins gave a power point presentation of how the food service is set up now and future plans for the new kitchen.  At the present time, entrees are prepared at Hanscom, packaged and shipped to Lincoln and then served to the children.  There is a tracking system used to identify time of packaging until arrival at Smith for serving, which is presently 2 ½ hours.  This is within the 4-hour limit that the State allows but eliminates the ability to use leftovers.  Mr. Creel said that any leftovers are discarded.  Mr. Creel is hoping that the Master Plan will result in a full service kitchen, which could also be used by the public, but this could be 5-7 years down the line.  He is hoping to get a hand sink in this summer and is planning on putting it in a location that will accommodate the full service kitchen of the future.  Mr. Creel said that he appreciates the work that Mike Moore and Gabrielle White, Public Health Inspector, have done for the school, including being able to set up a temporary hand washing station.  Mr. Creel made a presentation to the School Committee last week and told them that he was coming before the Board of Health for the variances.   He said that the School Committee wants to see if the Finance Committee will be able to get the money for the project so that the full service kitchen can be put in this summer, but he thinks that it will be part of a capital budget item for the future.  He did not want to go to FinCom without getting approval from BoH.  Mr. Creel said that there is no cafeteria at Smith and that tables and chairs are set up in the gym and taken down after lunch.  The members felt that they were comfortable with the situation in the short term but want to see progress toward a full service kitchen.  A motion was made to grant the 3 variances as requested but will require them to be renewed annually.  The motion passed 2-0 with a renewal date of April, 2008.  If the proposed changes do not make the capital budget, Mr. Creel will go back to Mike.  Gabrielle and Mike will continue to work with Cathleen Higgins and come back to the Board for any further variances.

Lincoln Public School  Septic System:
After reviewing the large septic system at Ballfield Road in 1999, DEP directed the LPS to begin work on a draft administrative consent order, which would lead up to a groundwater discharge permit.  LPS hired GZA GeoEnvironmental to work on the problem, but GZAs final recommendations were never forwarded to the Board of Health.  In a letter dated 12/11/02, DEP advised LPS that they can withdraw the application for a groundwater discharge permit and replace it with an application for a variance to calculate sewage flows using meter readings instead of head count.  The DEP variance requires local Board of Health approval first.  Granting this variance will allow the existing septic system that serves Brooks and Smith Schools to remain in use without going through the complicated procedures of obtaining a groundwater discharge permit from DEP.  The petitioner is asking the Board to approve one variance from Title 5:

1)      To estimate that the septic system, which serves Brooks School and Smith School is supporting a design flow of 7,856 gpd [i.e., 200% of the average water meter reading as per 310 CMR 15.416(3)], instead of 13,792 gpd [i.e., 15 gpd per person as per 310 CMR 15.203(5)].

Buck Creel said that in 1992 when Frank Emmons, former Town Engineer, came up with the 13,792 figure it was assumed that showers would be used and now the showers are not being used.  After a brief discussion, a motion was made to grant the variance as requested, and forward the approval to DEP for review.  The motion passed
2-0.  Mike will prepare the necessary documentation and forward it to DEP along with the return receipt requested forms received from the abutters notices.

Other Business:
39 North Great Road  Nancy Nelson has not formally requested to be put on the agenda for the April 3 meeting.
36 Beaver Pond Road  Mr. Binders request for a revised 4-bedroom deed restriction has been sent to Town Counsel for his review.  Because Town Counsel is busy with Town Meeting business, his review will probably not happen before March 24.  Town Counsel will get back to the members after he has had a chance to review the documentation.
