Meeting Minutes
May 2, 2007

The minutes from the April 4, 2007 meeting were approved as written.  The next two meetings are scheduled for June 6 and July 11.

Informal Discussions:

Deed Restrictions – The members discussed the various uses of deed restrictions, which the Town of Lincoln accepts.  Stan Sosnicki told the members that requiring a homeowner to file a deed restriction with the Registry to restrict the use of a garbage grinder may not be necessary since this restriction is noted in the design plan, permit  and on the Certificate of Compliance.  After a brief discussion, the members felt that they would prefer to continue to also require the restriction to be recorded with the Registry as an additional safeguard since this recording should show up on any sale of a house.  The deed restriction for limiting the number of bedrooms was also discussed.  The use of bedroom deed restrictions is at the discretion of the local Boards of Health.  When increasing the design flow by adding rooms, you need a septic system inspection and need to upgrade the existing septic system or a deed restriction limiting the number of bedrooms.  The members felt that this situation would police itself since a realtor cannot market a house for 5 or more bedrooms if there is a 4-bedroom deed restriction recorded with the Registry.  The members felt that if a resident was not willing to sign a bedroom deed restriction, they would be told that their other option would be to increase the size of the existing septic system.  The members reviewed a letter from Bob Domnitz, Chairman of the Planning Board.  Mr. Domnitz went to the DEP because the Planning Board did not believe that the Board of Health should have accepted a 4-bedroom deed restriction for 39 North Great Road.  This site is situated in a Zone 2 nitrogen restricted area because of a Town of Bedford well site.  This restricts the residence to 4 bedrooms on that size lot.  The proposed house has approximately 15 rooms and they agreed to sign a deed restriction limiting the house to 4 bedrooms.  The Planning Board would also like some restrictions on the number of proposed rooms when a 4-bedroom deed restriction is used.  The Board members said that they are not enthusiastic about using the Title V regulations and Lincoln’s local regulations to control particular developments in Lincoln.  They feel that controlling new development is the province of the Planning and Zoning Boards.  Stan also said that Title V regulations do not require abutters’ notices unless a system is within the neighbor’s property line or well or includes a DEP variance.  The members felt that, as a courtesy, they would continue to send out abutters’ notices.

Other Business:
Mosquito and Tick Season – The members felt that it would be a good idea to put another article in the paper about mosquito and tick season.  Elaine Carroll will look to see what we have on file for the next meeting.  Dr. Weinberg said that the Culex mosquito now passes West Nile Virus in the larva and eggs and doesn’t need to go through the birds anymore.  Mosquitoes like to breed in very shallow water and people should be reminded to get rid of standing water around their house.  
Minuteman Commons, 82 Virginia Road – Stan informed the members that Minuteman Commons does not have a Certificate of Compliance for its septic system.  A letter of non-compliance was sent to the Mayo Group almost a year ago and they responded saying that they would address the issues but so far they have not complied.  Stan said that the vents were cut down by landscapers and not replaced and no as-built plan has been received.  The members told Stan to send another letter to the Mayo Group.  Stan will also call the engineer to see what his status is and will add that to the letter.
Summer Camp at Farrington Memorial – Stan said that it appears that Farrington Memorial is operating as a summer camp and needs to be licensed as such.  Diane Haessler said that Farrington Memorial is set up as a day camp for other camps.  Stan said that even under those circumstances, Farrington must be inspected by the Building Inspector and the Fire Department and must be licensed by Lincoln even though the other camps are licensed by their individual towns.  Stan said that he and Gabi White will be notifying all the camps and sending out a package for each one.
State Reports – The members reviewed the reportable disease reports for this month.
Bill Paid – One bill was paid this month:  Staples in the amount of $8.21 for yellow paper for Hazardous Waste notification.
