Meeting Minutes
            July 11, 2007

The meeting was called to order at 7:35 p.m.  The minutes from the June 6, 2007 meeting were approved as written.  The next meeting is scheduled for August 29.

Public Hearings:

Septic System Review:
172 Weston Road – The existing system, which is a cesspool and leaching pit, was determined to be in failure by Action Concord Septic, Inc.  There is a steep slope on the lot with a significant number of trees, of which 4 or 5 would need to come down.  The petitioner is asking the Board to grant one variance from its local regulation:
(1)     To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203(2)
After a brief discussion, a motion was made and seconded to grant the variance as requested, provided that a deed restriction that prohibits garbage grinders is filed at the Registry of Deeds.  The owner, John Cook, said that the installed garbage grinder would be removed.  The motion passed 3-0.

39 North Great Road – Nancy Nelson came before the Board to request that the members reconsider the recent granting of a disposal system construction permit and 4 bedroom deed restriction for Lot B, 39 North Great Road.  Ms. Nelson said that the National Park was established in 1959 and has worked in cooperation with the surrounding towns.  She feels that this house would be inappropriate in the park area.  When she first talked to Mike Moore, she said that he told her that he was required to accept a 4 bedroom deed restriction for this parcel.  She has since learned that the granting of bedroom limiting deed restrictions is at the discretion of the Board members.  She felt that there should be an appropriate regularly sized system for a 15 room house.  Dr. Mansfield said that because the parcel is situated in a Zone 2 for a Bedford well, that size lot is limited to a 4 bedroom septic system (440 gal. per day per acre).  This meant that the owner had two options either downsize the building to a maximum of 9 rooms or be granted a 4-bedroom deed restriction.  Another option might be an alternative technology system for nitrogen reduction.  Dr. Mansfield said that the bedroom deed restriction is something that the Board members themselves have not dealt with in the past and that they relied on staff for these decisions and were unaware that it was at the Board’s discretion.  He also felt that this is something that should regularly come before the Board members and that there should be some guidelines set up as to when this should be used and what is reasonable for a bedroom deed restriction in relation to the room count.  He said that the Board does not want to use Title V as a way of controlling building in Town and tries to be fair with our neighbors.  Sara Mattes, Board of Selectmen, said that Lincoln wanted to support the surrounding towns as they have supported Lincoln.  Dr. Weinberg asked what this structure would be used as.  Mr. Frisardi, attorney for the owners, said that it is a single family residence and that they would be doing entertaining.  There would be no classrooms but they could be using some of the rooms for meditation.  Rosalind Stowe, sister of the owner, said that there is a new design for the house in the works, which she felt would be more appropriate to the site and the Town.  She also said that Global Country of World Peace would like to build a “Peace Palace” in Massachusetts but not on this site.  The members decided that since there is no new plan for this site before the Planning Board, any decision would be tabled until such time as a new plan showing the smaller design is presented to them.

Other Business:
Summer Camp at Farrington Memorial – The members reviewed a letter from Lt. John Whalen of the Fire Department to Kelley Mowers, Farrington Education Center, listing the items that need to be corrected in the barn area.  There was also an e-mail from Kelley to Lt. Whalen stating that all of the items on the list have been completed.
Bill Paid – Three bills were paid this month:  Eliot Community Human Services for the 4th Quarter in the amount of $1,250.00, Town of Lexington for an estimated amount of the May and June, 2007 Hazardous Waste collection days in the amount of $1,500.00 and Moore Medical in the amount of $58.04.
