Meeting Minutes
                November 5, 2008

The meeting was called to order at 7:30 p.m.  The minutes from the October 1, 2008 meeting were approved as written with one minor change.  The next scheduled meeting will be December 3, 2008.

Septic System Review:
13-15 Birchwood Lane – Duncan Brown, Engineer, and Jim Moore, President of the Lincoln Ridge Association came before the members to request 3 variances from the local regulations to allow for the reconstruction of a failed septic system on the same footprint.   The requests are as follows:

1)      To construct a leaching facility with more than 3 feet of cover material.  Approximately 4.5 feet of cover is proposed over a potion of the system.
2)      To allow a reduction in size of the system as allowed in 310 CMR  15.405.  The proposed design requires 1338 sq. ft. – 1332 sq. ft. is proposed.
3)      To construct a leaching trench longer than 50”, which is prohibited by local amendment to 310 CMR 15.252(1).

This system is about 30 years old and the trenches were inundated in the spring.  Brent Reagor told Mr. Brown that he would need to install a heavy duty box for variance #1, which he agreed to do.  The design calls for 56 feet for 3 trenches.  The area does not have the width for 4 shorter trenches.  Dr. Mansfield asked if they would be willing to sign a deed restriction prohibiting garbage grinders, which would mean a 50% reduction in the size of the leaching field.  Mr. Moore said that he would have no problem with that since there are no garbage grinders.  They were all removed 2 years ago.  Because this enables them to drop six feet off the leaching trench, which brings it back to 50 feet, there is no need for the third variance.  The following variance is added as the No. 3 variance needed:

3)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203.

A motion was made and seconded to grant the variances as requested provided that the Association files a deed restriction that prohibits the installation of any garbage grinders.  The motion passed 3-0.  

56-78 Birchwood Lane – After the initial meeting, Mr. Brown returned to the members and requested the same garbage grinder restricted variance for an additional application for 56-78 Birchwood Lane so that this system could also have a 50% reduction in the size of the leaching field.  The variance requested is as follows:

1)      To construct a leaching facility which is not increased by 50% to provide for potential garbage grinder installation whether or not a garbage grinder is initially installed as required by local amendment to 310 CMR 15.203.

A motion was made and seconded to grant the variance as requested provided that the Association files a deed restriction that prohibits the installation of any garbage grinders.  The motion passed 3-0.



Other Business:
Flu Clinic – The annual flu clinic for the Council on Aging will be held this Saturday, Nov. 15 at Bemis Hall from 9-11.
36 Beaver Pond Road – Dr. Mansfield officially signed the Certificate of Compliance for the gym/pool structure at 36 Beaver Pond Road.  The Certificate will be mailed to the owner and will then remove the reason for         Mr. Binder’s lawsuit against the Town.  
Lincoln Mall Restaurant – Brent Reagor reported to the members that the restaurant has received its approvals and there will be an additional inspection after the installation of the kitchen is complete.
The Groves – Brent also said that the Groves has been signed off for kitchen reviews.  
Bills Paid – four bills were paid – Eliot Community Human Services in the amount of $1,250 (first quarter payment), Moore Medical for additional medical supplies for the flu clinic in the amount of $4.69, Commonwealth of Mass., for the second quarter payment of the East Middlesex Mosquito Control in the amount of $2,500 and Town of Lexington for the Sept. 21 Haz. Waste Collection in the amount of $749.39.
Communicable Disease Reports – The members reviewed the latest communicable disease reports for October.   Dr. Weinberg was concerned by a report of salmonella typhi in two patients and will do further consultation with Maureen Richichi, School Nurse, regarding the reports.
