COMMISSIONERS PRESENT: Elizabeth Frumkin, Jim Henderson, David Katsuki, Mary Lincoln (chair) & Sara Silverstein. STAFF: Tom Gumbart.
WETLAND FILINGS
Public Meeting - Request for Determination of Applicability: Frederick Mansfield, 12 Mackintosh Lane (Map 84-Block 7-Lot 0).
The applicant, Frederick Mansfield, proposed a new garage addition to an existing single family home. The structure lies just inside of the 100-foot buffer zone and the construction will be over the existing paved driveway. Stormwater roof drainage will be discharged through a pipe into the outer buffer zone. The Commission voiced concern over that discharge and requested that stones be properly placed at the point of discharge for disbursing the flow to prevent scouring of the slope. No clearing of vegetion or grading will occur within the buffer zone.
The Commission voted 6-0 to issue a negative Determination of Applicability allowing work to proceed.
ACTION ITEMS
Order of Conditions signed for: Ken Eisner (Countryside Building Corp.), 215 Lincoln Road (Map 102-Block 16-Lot 0). For teardown of an existing structure and construction of a new home with work within the buffer zone.
Order of Conditions signed for: EDCO (The Education Collaborative) at Minuteman Regional Vocational Technical School (Map 19-Block 4-Lot 0). For proposed road crossing of an intermittent stream and associated drainage structures, sidewalk, and utilities. The vote to issue the O.O.C. was four in favor and one against .
Certificate of Compliance issued for: Rocklage DEP #203-725, 179 Sandy Pond Road (new deck).
Group Use Permit was issued for: Sudanese Education Fund - Fundraising Walk.
Bills were paid and payroll signed.
DISCUSSION ITEMS
Wetlands and Conservation Restriction Issues at 106 South Great Road
Matt Trombadore and Joanne Wood own this property. The Commission requested that Mr. Trombadore and Ms. Wood attend an upcoming meeting to discuss tree and brush clearing and property posting that has occurred on their property. They could not attend this meeting. Mr. Trombadore, in a telephone conversation with Tom Gumbart, said that they should soon have a property plan that shows the topography with a wetlands delineation and the buffer zone marked on it. Curtis Young, of Wetlands Preservation Inc., is working with the family and he is expected to contact Mr. Gumbart soon to discuss the issues on the property. Mary Lincoln is drafting a letter to send to the owners.
Wetlands Violation at 1 Grasshopper Lane
On March 8th the Conservation Department received two calls regarding activity that may be within wetland resource areas at 1 Grasshopper Lane. Sean Hale and Tom Gumbart met that same day with the owner, Richard Johnson, regarding the activity. There has been extensive clearing of brush and trees within wetland and buffer zone areas. Mr. Johnson was asked to cease and desist from any further activities and the Commission has scheduled a site visit for March 16th to view the site.
LLCT Neighborhood Discussion Feedback (Old Concord Road area)
The Commission reviewed the written synopsis of this meeting that was compiled by Sue Klem. Clearly the item of most concern at Mt. Misery is the issue of dogs off leash. The Commission agreed that the issue needs to be revisited. David Katsuki offered to draft a short questionnaire that could be filled out at Town Meeting to gather some input. It was also decided that another field survey should be done to get more data on dogs at Mt. Misery. After those steps the Commission will likely hold one or more public hearings to get input from the public regarding any management changes that should occur.
Another concern voiced was the use of Old Concord Road as parking for Mt. Misery access. The issue of beaver impact on the land was also raised. At this time the Commission wants to continue to monitor the beaver situation before taking any immediate action. Lower water levels or beavers moving on their own may affect the extent of impact on LindenTree's agricultural operation.
Suasco River Stewardship Award
The League of Women Voters is again cosponsoring this award that will be given out during RiverFest in June. The Commission discussed the water chestnut project as a possibility.
