MINUTES

COMMISSIONERS PRESENT:  Toby Feibelman, Jim Meadors, Sara Silverstein, & David Katsuki.  STAFF: Tom Gumbart, Angela Kearney.

DISCUSSION ITEMS

Dogs at Mt. Misery

Tom briefed the Commission on other Town and Conservation Organization’s dog policies.  There is a wide range of policies and regulations but almost everyone spoken to concurred that they also have land management difficulties presented by dog walkers.  While the Commission is moving ahead in revising the dog policy at Mt. Misery, serious consideration is needed as to how the policy will be enforced and what potential impacts on other Town conservation lands may come as a result of implementation.  The Commission also needs to be sure that LLCT is in support of the policy.  Based on a discussion between Tom and Kevin Mooney, the Chief of Police, the police will support the Commission in enforcement as needed.  Discussion with MACC legal counsel confirmed that the Commission can set rules and regulations on conservation land without a public hearing but that the hearing route is an appropriate way to proceed with changes.  

Mt. Misery Beaver Dam

Tom Gumbart was prepared to send a letter to all abutters stating that it is illegal to dismantle or alter beaver dams without a permit, but then realized that there are a huge number of abutters when the whole property is considered.  Sean Hale and Jane Layton posted signs at the dam and no one has tampered with or dismantled it since.  The Commission discussed briefly the importance of fully exploring all options prior to making any decision. With the Mt. Misery dam in particular, members at this meeting supported exploring all options for providing Lindentree Farm with additional land prior to altering or dismantling the beaver dam. More discussion will take place when all Commissioners are present.  Mark Hopkins from Cedar Road came to discuss the beavers, but said he would come back when there was more formal discussion.

ACTION ITEMS

Sara Silverstein was appointed to represent the Conservation Commission on the Community Preservation Committee.
