WETLANDS FILINGS
Notice of Intent – Continued from August 6, 2008. Konstandakis, Nicholas 22 Old Cambridge Turnpike. For restoration plantings within the Buffer Zone Resource Area (24-6-0).
Stacy Carpenter, presented a revised plan with specific plant species, locations and densities. She presented a revised narrative outlining the installation methods and schedule. All fill will be removed and plants will be installed by mid-October 2008. The Commission required that Stacy or another professional wetlands consultant be present on site during all phases of the restoration work. The Conservation Staff shall be notified during each phase of work and shall be present when the pool is being temporarily relocated to determine the most suitable storage location. A plan for the proposed pool shall come before the Commission under a separate Notice of Intent filing and there is no guarantee that the Commission will approve the location in the Buffer Zone Resource Area. The filing fee will be adjusted at the time of the new Notice of
Intent.
The Commission voted 6-0 to close the hearing and issue an Order of Conditions.
DISCUSSION ITEMS
Grindlay, 145 Old Concord Road – Unauthorized Vegetation Clearing Activity
Joshua Grindlay came before the Commission to discuss the costs associated with completing the wetlands delineation, survey plan and Notice of Intent. The Commission explained that this is the standard and required process for all residents seeking to do work within the Buffer Zone Resource Area. This was a serious violation and it is the Commission’s responsibility to uphold the law and to look out for the community who participated with a certain understanding in the large conservation project. The information is required to establish a known base from which the homeowner and Commission can work from and to fully understand the proposed restoration work within the context of the natural resources on the property. They suggested that Mr. Grindlay contact other wetlands professionals for additional estimates as the pricing he received
did seem somewhat high to the Commission. Mr. Grindlay agreed to obtain additional estimates for the work and indicated that he understood the reasons for the Commission requiring the work to be done. He questioned whether it was necessary to have the entire duck pond lot surveyed as they did not intend to do work there in the future. The Commission requested that Mr. Grindlay get a price to do that portion of the work as it may still affect allowable work on other areas of the property.
Gutierrez – 16 Old Sudbury Road – Unauthorized Vegetation Clearing and Wetlands Fill
Tim Burke, architect represented the applicant during the discussion. Mr. Burke had not seen the clearing, but reviewed photos that were taken by Conservation Staff. He was surprised that the work had taken place as both he and David Burke, wetlands resource specialist had told the homeowners not to proceed with any work on the property until a full plan was prepared. The Commission discussed the extent of vegetation clearing. They agreed that the initial planning steps outlined in a letter to the Gutierrez’s dated August 14, 2008 should be taken as soon as possible. These steps included:
• Full wetland and upland resource area delineation – include perennial and/or intermittent streams, bank, pond, bordering vegetated wetland, 50-foot buffer zone, 100-foot buffer zone and 200-foot riverfront area if applicable.
• All delineation points shall be located on the base plan by field survey.
• Include the full perimeter of the main house property and smaller parcel adjacent to the railroad track. Include all building and major landscape features.
• Include all woodland edges (edge of tree and shrub canopy line, not trunks).
• Survey and identify all field trees over 6” DBH.
• Survey all stumps that were cut and identify the diameter of each stump.
• Survey topography at 1-foot contour intervals adjacent to Old Sudbury Road, around all buildings, to the woodland edges down the backyard and around the pond, along the backyard stream and banks and out to the wetland resource area boundaries around the back fields.
• The scale shall be at 40 feet/inch or at a scale with finer resolution.
Several Commissioners had not been out to the site and will do so prior to the September 3rd meeting. At a minimum the Commission will require a comprehensive restoration plan and non-native, invasive plant management plan. They may also determine that immediate soil stabilization methods must be implemented and may determine that fines are necessary. The Commission will continue the discussion at its September 3rd meeting.
