WETLANDS FILINGS

Notice of Intent Continued from June 4, 2008. Department of Conservation and Recreation. Walden Pond State Reservation (Map 39-Block 10-Lot0). For rehabilitation of the east bank of Walden Pond including safety pruning, additional planting and improvement of the storm-drain system within the buffer zone resource area.

The Commission reviewed the plans and noted the details pertaining to the proposed roadway and parking lot re-grading. They did not see the details for the proposed path above the stone wall along the eastern edge of the pond. Aside from ensuring that those details make it on the plan, the Commission was pleased with the proposed restoration work.

The Commission voted 6-0 to continue the hearing to 7:45 on July 16, 2008.

Notice of Intent. Paul Pedini. 11 Reiling Pond Road (Map 33-Block 11-Lot 6). For the construction of a new, single-family home within the Buffer Zone Resource Area.

Paul Pedini proposed a plan to construct a new, single-family home on a legal building lot that was created prior to March 29, 2003. The building envelope is highly constrained by property setbacks, ledge, suitable soils for the septic system and desirable vegetation. The proposed structure will work with these constraints by using an alternative, pre-fabricated building system that does not require a significant amount of grading or site disturbance. The closest point of permanent disturbance is approximately 80-feet from the Wetland Resource Area. Mitigating factors include the use of a crane to erect the house, installation of green roofs, storage tanks to collect storm-water runoff, a grey-water reuse system, porous paving on the driveway and minimal vegetation clearing. The only alternative building location outside the 100-foot Buffer Zone Resource Area is where the soils were suitable for the septic system.

The Commission noted that the plan as proposed was a creative, ecological solution to a very challenging building site. The Commission supported the applicant’s request to the Planning Board to relocate the building envelopes of both Lots 6 and 7 farther away from the wetlands and will prepare a memo to the Planning Board stating such. The Commission noted the alternative construction method and mitigating factors and encourage the applicant to restore the naturalized character of the site after construction.

The Commission voted 6-0 to close the hearing and issue an Order of Conditions.

Notice of Intent. Joshua Jade. 56 Conant Road (Map 107-Block 8-Lot 0). For an addition and landscape improvements within the Buffer Zone Resource Area.

Dave Burke, Wetland Resource Specialist represented the homeowners with a plan to construct an addition, approximately 265 square feet of which is located in the outer 100-foot Buffer Zone Resource Area. Because of the deck-house style and north-south orientation of the house, the addition must be added in its proposed location. The addition will not extend any closer to the wetland than the back of the existing house, approximately 82’ from the wetland resource area. Additional proposed work within the Buffer Zone Resource Area includes:
•       the removal of 5 white pine trees which pose a threat to the house and need to be removed in order to allow for the addition;
•       native, restoration plantings along the back slope and in northern corners of property;
•       repair of existing stone wall and patio;
•       removal of a wooden fence.

Efforts to minimize impacts to the wetland resource area include the removal of an existing deck on the back side of the existing house, planting of 5 native canopy trees, native, restoration plantings; maintenance of the lower meadow as open wildlife habitat and invasive species control. Stormwater infiltration will be improved by infiltrating all runoff from the existing and proposed structure into stone drip edges and perforated overflow drains to an infiltration tank.

The Commission was satisfied with the proposed project, particularly given that they had previously approved a complete tear-down and reconstruction of the single-family house. They noted that the applicant proposed to keep the Buffer Zone Resource Area in a naturalized condition with a maximum of two mowings a year and supported the replacement screening trees. Two neighbors voiced their support for the project, but wanted to ensure that the undisturbed character of the wetland resource area remain undisturbed and protected.

The Commission voted 6-0 to close the hearing and issue an Order of Conditions.

DISCUSSION ITEMS

Railroad Culvert Replacement Project
Tom Gumbart conducted a site visit with representatives for the project and issued an Emergency Certification to begin clearing and access work. The MBTA is preparing a Notice of Intent for submittal on July 16, 2008.

Booth Property
Because of challenges pertaining to a Town owning land in another Tow for conservation purposes, the Commission voted unanimously in support of having the Lincoln Land Conservation Trust own the portion of the Booth property which is located in Concord and keeping the same conservation restrictions on that parcel.
