The minutes from the March 15, April 26, May 10 and May 17 meetings were approved with corrections, which will be made.
Paul Marsh, 61 Bedford Road:
The members were asked to vote on the Preservation Restriction Agreement, which was set up by Paul Marsh on his property. Since none of the members had seen a copy of the agreement, a motion was made and approved to put off a vote until the members have had a chance to review the documents. A copy of the agreement will be sent to the members.
Certificates of Appropriateness:
20 Trapelo Road fence and plantings around pool and spa:
The members reviewed a revised landscape plan (revision dated 6/2/05) showing plantings of China Girl Holly and a wrought iron fence enclosing the pool and spa. The members unanimously approved the new plantings and fence but are still requesting a plan showing additional screening around the east side of the tennis court, which was never put in. Colin Smith will send out a Certificate of Appropriateness approving the fence and plantings around the pool and spa and requesting a revised proposal for a planting screen around the east side of the tennis court.
23 Bedford Road alteration (demolish and reconstruct dwelling):
This hearing is a continuation of the April 26 and May 10 and May 17 meetings. Colin Smith read into the record a letter the Lammerts attorney dated 5/18/05 extending the deadline for a decision until June 30, 2005. Letters received in support of the Lammerts application were from John LeGates dated 5/26/05 and from Ed and Bean Nardi dated 6/4/05. Letters received in opposition to the Lammerts application were from Jonathan Keep with an article regarding Toshiko Mori dated 5/23/05, additional article from Henry Hoover regarding Ms. Mori, letters from Emily Althausen dated 5/29/05, Sudbury Historic Districts Commission dated 6/6/05 and FoMA dated 6/6/05. All of these letters and articles are in the HDC files. Colin Smith told everyone present that the members would review the
changes to the proposed house and then he would open the meeting to only new comments. Ann McCallum showed the members a revised plan showing substantial changes to the proposed house. Gary Hildebrand, Landscape Architect, showed a drawing showing the house and landscape from Bedford Road and from inside the tree line on Bedford Road. Andy Burr showed a model of the house, which used real contours. He said that the large third door on the garage would allow you to drive through to the barn in the back with doors that open on both sides. David Ries felt that this design was a significant improvement and Ken Hurd said that he was comfortable with the design.
At this time the meeting was opened to the public for further comments. Colin Smith was asked how the process works and Colin said that permission to demolish could not be given unless the members are satisfied with the proposed house. The two are linked together. Approval to demolish would not be given if it were felt that demolishing this building would denigrate the Historic District. He said that there are no absolutes in the Historic District. At this time, Paul Giese read the letter received from FoMA dated 6/6/05. After further discussion from both sides of the issue, David Ries moved to close the hearing to further discussion and go into a closed session. The motion was unanimously passed.
After the members discussed the issues, David Ries moved that the Lincoln Historic District Commission approve the application for a Certificate of Appropriateness filed by James W. Lintott, As Trustee of the 23 Bedford Road Nominee Trust and Kathleen Lammert on April 1, 2005 seeking approval of the demolition of the house presently on the property and the construction of a new home in substantial accordance with the plans submitted to this Commission on June 7, 2005, as such plans may be modified by further action of this Commission, subject to the following conditions: 1) The applicants must obtain final approval from the LHDC of detailed plans and specifications for the new construction consistent with the plans presented to the Commission on June 7, 2005. 2) The applicants must obtain site plan
approval for the new construction and its related site work from the Lincoln Planning Board, and all other municipal permits and approvals for such work. 3) The applicants shall prepare a detailed photographic record of the existing house both interior and exterior, for the records of the Commission. 4) The applicants shall submit for Commission review and approval a fully executed document imposing on the property in perpetuity the following restrictions: a) only one single family residence shall be constructed or allowed to remain on the 6.5 acre parcel constituting the property; b) a conservation restriction running along its entire Bedford Road frontage 40 feet in width limiting the use of such property to landscaping and driveway, in accordance with the plans presented to this Commission; c) no further sub-division of the property. 5) Demolition of the existing residence (the former Heck House) shall not take place until all of the foregoing conditions
have been satisfied to the reasonable satisfaction of this Commission. The motion was seconded and was passed 5-1. The vote will be written up and a final vote taken at the next meeting on June 21. The members felt that although this was a painful process, both sides of the issue represented themselves well.
