MINUTES OF THE BOARD OF APPEALS
July 9, 2002

The Board of Appeals met at Town Offices on Tuesday, July 9, 2002 at 7:30 p.m.  Present, Buck Creel, Chairman, Pam Green, Joseph Greeson, Susan Mygatt, and Nancy Zuelke, Clerk.  

1.      A request to postpone the hearing for Michael Danziger, 231 Old Concord Road was received. The hearing was postponed to August 20, 2002.

2.      Applicants were informed that there were only 4 members of the Board present and they had the option to postpone their hearing until 5 members could be present.  All applicants chose to proceed with their hearing.

3.      The Board heard the petition of John and Susan Valpey, 135 Bedford Road for a special permit to construct additions to their residence on a non-conforming lot.  Petition was presented by Mr. & Mrs. Valpey and their designer, Sam Rappaport.  No interested parties appeared at the hearing or communicated with the Board.  The hearing was closed.

Following the hearing a sense of the Board was that Susan write a decision approving the special permit.

4.      Pam chaired the next hearing on the application of G. Alexander Creighton, 117 Lincoln Road for a special permit for an accessory apartment in his residence.  Letters from the Planning Board and Board of Health were received.  Mr. Creighton presented the Board with a letter from the Housing Commission.  No interested parties appeared at the hearing or communicated with the Board.  The Board noted a violation of the setback requirements as indicated in the as built site plan.  Mr. Creighton was advised to take care of this matter in the future.  The hearing was closed.

Following the hearing the Board tentatively voted to grant the special permit subject to the decision being written by Buck.

5.      Buck resumed chairmanship.  The Board heard the petition of Christian Reich and Parisa Zamiri, 72 Codman Road for a special permit for an apartment in their residence and a special permit to construct a garden shed on their non-conforming lot.  Letters were received from the Planning Board and the Board of Health.  No interested parties appeared at the hearing or communicated with the Board.  The hearing was continued to August 6, 2002 to receive information as to whether the portion of the house in which the apartment would be located was more than ten years old, the number of bedrooms approved by the Board of Health, the results of the fire inspector’s review of living quarters over the garage.  Mr. Reich was also asked to bring pictures of the front of the house looking toward the location of the proposed garden shed.  Joe will write the decision when made.

6.      Pam again chaired the hearing on the petition of Stephen Hoenig, 25 Longmeadow Road for a special permit to construct additions to his residence on a non-conforming lot.  Mr. Hoenig stated he had a petition signed by neighbors stating they had no objections to the additions.  The Board asked that this petition be brought in as soon as possible.  The house requires site plan approval by the Planning Board.  The Board noted that design and layout of the bedrooms over the garage and the potentially private entrance to the living area over the garage created the appearance of a potential apartment.  The hearing was continued to August 6, 2002 for receipt of the Planning Board letter and possible revisions to the design and layout of the proposed addition.  Buck will write the decision when hearing completed.

7.      Buck resumed chairmanship and reopened the continued hearing on the Yagjian request for a frontage variance to allow construction of a cell tower on the Yagjian property off Cambridge Turnpike.  Lou Levine, representing Cingular, and Tim Cross, representing Sprint, expressed their desire to have the Planning Board and Conservation Commission permitting process completed before the Board issues the variance.  The hearing was continued to August 20, 2002.

8.      The Board signed the decisions relating to the applications of William Hamilton/Barbara Sampson, 126 South Great Road; Bruce Repko, 20 Orchard Lane; Lincoln Crossing, LLP and Cambridge Trust Company, 152 Lincoln Road.

Buck stated that the Judge has denied the Plaintiff’s motion for preliminary injunctions regarding fines at Millbrook Farms.

It was also reported that L.V. Realty, the new owner of 170 South Great Road plans to present a proposal for housing on the site.  They will meet with Town Officials in early August.  The hearing on the requests for summary judgment will be held on September 15.

The Board discussed the work being done by Ernest and Madaline Jacquet at 49 Round Hill Road.  The Board suggested that Earl issue a partial revocation of the building permit for this work.  If the Jacquets object to the revocation, they have the right to appeal the decision of the Building Inspector to the ZBA.

The meeting adjourned at 11:35 p.m.
