MINUTES OF THE BOARD OF APPEALS
August 20, 2002
The Board of Appeals met at Town Offices on Tuesday, August 20, 2002 at 7:30 p.m. Present, Buck Creel, Chairman, Pam Green, Joseph Greeson, Peter Guldberg, Susan Mygatt, and Nancy Zuelke, Clerk.
1. The Board discussed the order of events for the August 22 meeting beginning with the DPW cell tower, the Public Safety cell tower, the Yagjian cell tower and Stonegate Gardens. A vote on the cell tower applications on the DPW property and the Public Safety property will be taken and the signing of the decisions on these two applications will take place shortly thereafter.
2. The Board heard the petition of Jane Wei and Kevin Skillern, 259 Concord Road for a special permit to construct dormers on their residence on a non-conforming lot. A letter was received from Mr. & Mrs. Oliver Hayes in support of the application. Ms. Wei presented a letter from the Board of Health. No other interested parties appeared at the hearing or communicated with the Board. The hearing was closed and the Board tentatively voted to grant the special permit subject to construction being done substantially in accordance with the plans. Peter will write the
decision.
3. The Board heard the petition of Neal A. Maxymillian, 5 Longmeadow Road for a special permit to construct an addition to his residence on a non-conforming lot. He stated that abutters had expressed their approval to Mr. Maxymillian. The hearing was closed and the Board tentatively voted to grant the special permit subject to construction being done substantially in accordance with the plans. Joe will write the decision.
4. The Board heard the petition of Mark and Gaby Soyka, 15 Conant Road for a special permit to construct additions to their non-conforming residence. Mr. Soyka stated that a building permit had been taken out to remodel the kitchen and add a carport to the barn. He also stated that he had begun construction of a bedroom on the house, and had begun finishing the second floor of the garage with another bedroom, but that the Building Inspector had ordered him to stop the work. The Board asked Mr. Soyka to have the Town Engineer determine whether the septic system was adequate for the number of bedrooms existing in the house (including the new bedroom he has begun to construct), and if so, for the proposed bedroom in the garage. The bedroom in the garage is not permitted without a special
permit for an accessory apartment, and the new bedroom in the house is not permitted without a special permit for the alteration of a non-conforming structure. A letter was received from Mr. & Mrs. Puffer. Nancy Harris, Henry Rugo and Barbara Peskin spoke at the hearing, objecting to the work done on the lot. The hearing was continued to no later than October 22, 2002 so that Mr. Soyka could present Board of Health information, and perhaps an application for an accessory apartment. Peter will write the decision when the hearing is closed.
5. The Board heard the petition of Andrew and Judith Hall, 71 Sandy Pond Road for a special permit to reconstruct and enlarge a porch on a non-conforming structure. No interested parties appeared at the hearing or communicated with the Board. The Board tentatively voted to grant the special permit subject to construction being done substantially in accordance with the plans. Pam will write the decision.
6. The Board heard the petition of Deborah Spragg, 14 Winter Street for a special permit to construct a porch on her residence on a non-conforming lot. Don Hawkes of Finemann Remodeling represented Ms. Spragg. A letter from the Planning Board indicated that the addition did not require “big house” site plan approval. No other interested parties appeared at the hearing or communicated with the Board. The Board tentatively voted to grant the special permit subject to construction being done substantially in accordance with the plans. Buck will write the
decision.
7. A request to postpone the hearing for Michael Danziger, 231 Old Concord Road was received. The hearing was postponed to September 12, 2002 provided all parties could be in attendance. The request for postponement from Mr. Danziger’s attorney also extended the date by which the Board must hold a public hearing until September 24.
At 10:25 p.m. the Board voted to go into executive session for the purpose of discussing on-going litigation. It was voted as follows: Joe – yes, Buck – yes, Susan – yes, Pam – yes, Peter - yes. The Board would not be returning to open session.
