MINUTES OF THE BOARD OF APPEALS
August 22, 2002
The Board of Appeals met at Town Offices on Thursday, August 22, 2002 at 7:30 p.m. Present, Buck Creel, Chairman, Pam Green, Joseph Greeson, Peter Guldberg, Susan Mygatt, and Nancy Zuelke, Clerk.
1. The Board reviewed the draft decision for the variance from the height of the cell tower at the DPW site, 30 Lewis Street. Decision was edited and it was voted to approve and sign the decision.
2. The draft of the cell tower variance at the Public Safety Building, 169 Lincoln Road was reviewed. It was voted to approve the variance to be signed when references have been inserted.
3. The Board discussed the Yagjian cell tower variance on Cambridge Turnpike. The Planning Board has approved a monopole at a specific location on the Yagjian property. A sense of the Board vote was taken to approve the requested variance, subject to approval of the Conservation Commission and final review and approval of legal documents and easements providing access equivalent to the applicable frontage requirements.
4. It was suggested that the Building Inspector should regularly inspect the Soyka property at 15 Conant Road to be sure work has stopped on the additions and the barn is not being used as a dwelling.
5. The draft of the decision for Stonegate Gardens, 339 South Great Road for renewal of their special permit was discussed. The permit will be renewed for one year. The applicant’s request for a three year extension of the permit and for the extension of holiday hours of operation will be denied.
At 10:30 p.m. the Board voted to go into executive session for the purpose of discussing on-going litigation. It was voted as follows: Joe – yes, Buck – yes, Susan – yes, Pam – yes, Peter - yes. The Board would not be returning to open session.
