Planning Board Minutes, April 2, 2008
TOWN OF LINCOLN
MINUTES OF PLANNING BOARD MEETING
Held April 2, 2008
at 7:30 PM in the Donaldson Room, Lincoln Town Offices

PRESENT:  R. Domnitz (Chairman), K.Hurd, B.Wolf, J. Craig, J.Snell
STAFF:  M.Whitehead, C.Perry

7:30 PM   BUSINESS:
The Chairman welcomed James Craig as the newly elected member of the Board.

Presentation to Ephraim Flint, retiring member
The Board thanked Mr. Flint for his good service over five years and presented him with a book on John Deere tractors.

Town Meeting debrief
The Board reviewed the items that it presented at Town Meeting. On the article related to preliminary meetings for site plan review, a resident raised the question of neighbor notification. The Board defended the article as proposed and it was passed. The Board noted the concern and considered that it would be advisable to do informal neighbor notification.

Breiter, Hobbs Brook Farm, Reiling Pond Road
The Board signed the decision approving a change to the sound barrier wall in the cluster subdivision.

Hatsopoulos, 3 Woodcock Lane
The Board signed the decision approving a greenhouse.

DISCUSSION OF SPRINT VIOLATION:  Yagjian Property, 37 Cambridge Turnpike, Map 24/ Lot 1, failure to install shield as required by special permit.
The Board reviewed the terms of the special permit. Mr. Domnitz has visited the site and confirmed that there is currently no shield on the light. The Building Inspector has received plans which show a shield, and Sprint has been supplied with a copy of information about an available shield. The Board noted that Sprint has not yet filed post-installation emissions measurements or ‘as built’ plans. It noted that the nearby resident who had experienced problems with access traffic was satisfied with the sign that was installed.
A MOTION was proposed by Mr. Hurd and seconded by Mrs. Wolf, to authorize the Chairman and Town Planner to write a letter informing Sprint of the suspected zoning violations and notifying the Building Inspector.                             Passed 5-0

DISCUSSION OF DEACONESS CLEARING:  17-19 Cambridge Turnpike, Map 14/Lot 16
Board members and residents have raised questions about the extent of tree clearing near to Route 2 on the Lincoln side of Crosby’s corner. Mr. Whitehead confirmed that the limit of clearing shown on the documents approved for the special permit goes right up to the Deaconess property line. The Board examined the approved landscape plan. Within the site, the trees that are shown to be kept near Bethany Road are believed to be still there. In the Right of Way of Route 2, clearing has taken place. The project team has informed Mr. Whitehead that following the application to Mass Highway for a curb cut, a deceleration lane is being constructed for vehicles entering the site. Mr. Whitehead has been sent a copy of the plans. The Board commented that it will have no jurisdiction over changes that are within the Route 2 Right of Way. It asked Mr. Whitehead to set up a site meeting with Deaconess project staff to clarify the work that is being done in various locations.

DISCUSSION OF FLINT PROPERTY:  Chapter 61A recommendation to Board of Selectmen regarding Town’s Right of First Refusal, 5 Sandy Pond Road, Map 53/ Lot 6-3
Warren Flint wishes to sell the house to the Atkins and has submitted a request to the Board of Selectmen concerning the Town’s right of first refusal under Ch 61A. Copies of the letter were distributed. The Planning Board’s views are likely to be sought by the Selectmen.
The Board reviewed plans showing the Ch 61A restriction and the Agricultural and Conservation Restriction, and the ANR lot plan that the Board previously signed. The conservation restriction overlaps the house lot. Mr. Whitehead reported that the conservation restriction is in perpetuity and that the Conservation Commission has reviewed the issue and is satisfied that the open land will be adequately protected if the private sale goes ahead. The Planning Board concurred with this view and saw no reason for the Town to purchase the property.
A MOTION was proposed by Mr. Hurd and seconded by Mr. Craig, to recommend to the Selectmen that the Town not exercise its option to purchase the property at 5 Sandy Pond Road.                                                                         Passed 5-0

BOARD REORGANIZATION AND UPCOMING SCHEDULE
The Board elected officers as follows:
A MOTION was proposed by Mrs. Wolf and seconded by Mr. Snell, that Mr. Domnitz be the Chairman for the coming year                                              Passed 5-0
A MOTION was proposed by Mr. Hurd and seconded by Mrs. Wolf, that Mr. Snell be  the Vice Chairman for the coming year                                   Passed 5-0

Committee representation was reviewed and the following were agreed:
Historic District Commission (two nominations): Mr. Hurd and Mr. Craig
HATS (Hanscom Area Towns): Mr. Domnitz, with Mr. Craig as alternate
MAGIC (Minuteman Advisory Group on Inter-local Coordination): Mr. Whitehead (with Sara Mattes), with Mr. Domnitz and others attending some meetings.
HOME consortium: Mr. Whitehead
CLRP: Mr. Hurd is Chair. Members are involved in some of the sub-committees.
CPA (Community Preservation Act): Mrs. Wolf.

Mr. Whitehead outlined the upcoming schedule. Several site-specific discussions are scheduled for April 16th. It was agreed to use the April 9th meeting for discussion of some current topics such as Ch 40B and over 55 housing, and for approval of minutes. Members were asked to consider further topics.

EXECUTIVE SESSION:  Egendorf appeal of decision, 10 Tower Road, Map 74/ Lot 24
The Board took a roll call vote to go into executive session to discuss strategy concerning pending litigation, and then to return to open session:

OTHER BUSINESS:
Hall, 20 Garland Road
Mr. Whitehead reported that the owners wish to make a change to the proposed house addition that was approved in January. The Board agreed that this could be processed as a minor change and considered at the next meeting.

Geographic Information System: new data layer
Mr. Whitehead presented a request from the Board of Assessors for a financial contribution of $1,000 towards developing a GIS data layer of building footprints. Contributions are also being sought from other boards.
A MOTION was proposed by Mr. Hurd and seconded by Mrs. Wolf, to authorize up to $1,000 from the Planning Board budget to fund a contribution towards creating a building footprint data layer.                                                          Passed 4-1

White Church, Bedford Road
The Chairman reported that he asked Town Counsel for an opinion on how the church could proceed with expansion plans. The opinion was that the church may either pursue any zoning exemptions needed under Section 19.1(e) via limited site plan review, or apply to the ZBA for a special permit for a change to a non-conforming structure.

Town Planner’s report
Mr. Whitehead distributed copies of correspondence relating to issues between Mr. Naiman and Mr. Brodney of Huntley Lane. The Building Inspector has responded to Mr. Naiman’s attorney.
A meeting will be held on Saturday April 5th involving housing groups to discuss a group home proposal.
Mr. Whitehead also reported on matters before other land use boards.

Reports from committees:
HATS
Mr. Domnitz and Mr. Hurd reported briefly on the previous week’s meeting.
MAGIC
Mr. Domnitz attended the legislative breakfast which had a focus on transportation. In leading the discussion, Marc Draisen of MAPC concentrated on forms of revenue that could be raised for road funding, but Sara Mattes spoke in favor of coordinated transportation planning including public transportation.

Arena Farm, Concord
Mr. Snell mentioned that Concord Academy has purchased the Arena Farm site adjacent to Route 2 and the Fitchburg rail line, which could have potential for transportation-related facilities.
