Minutes of the Zoning Board of Appeals Meeting of 2/8/07
Meeting convened at 7:30 pm in the Conservation Office at Town Hall. Present: Pamela Green, Chair, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle, and Dorothy Blakeley, BOA clerk.
New Matters:
1) Craig Furman and Louise Bergeron, 244 Lincoln Road, M/P 115 13 0, Applicants, owners of a single-family residence on a non-conforming lot, seek special permit to enlarge existing back ell, which currently consists of 470 square feet. They would like to add approximately 1,000 square feet to increase the length of the small crowded rooms. The total square footage of their farmhouse with the proposed addition would be just short of 3,000 square feet. The proposed addition would be solely to the back of the existing home, with no change to the front or side lot lines. It will not obtrude into the rear setback. There will be no increase in height. Neighbors Toby and Wesley Frost, 233 Lincoln Road, came to this hearing to express their support of this project. The Board of
Health has reviewed and approved the septic plan for the house as modified by the proposed addition.
Action: Panel consists of Pamela Green, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle. Anna Hardman is Decision Writer. Motion to close the record approved unanimously. Motion to grant the special permit approved unanimously.
2) Stonegate Gardens, 339 South Great Road, M/P 124 7 0, Application for renewal of special permit regarding a pre-existing non-conforming use of residential property. Applicant, Stonegate Gardens, Inc., was represented by Lynne Bower (manager), Bruce MacDowell (an owner) and Attorney Michael Vhay. Stonegate sells plants and trees nurtured on the premises, as well as a variety of related items, under the terms of a settlement to litigation involving its operations at the site. The latest special permit issued by the Board to govern operations at the site is a three year permit. The purpose of the hearing was to verify compliance with all conditions imposed on the use of the property for Stonegate’s operations.
The applicants said that they believed that they were in compliance with all conditions imposed by the Board and that nothing had changed in the three years since the permit was renewed. Ms. Bower said that the lighting plan imposed by the Planning Board was strictly adhered to and that deliveries to the premises were strictly monitored.
Mr. Cecil Thomas of 34 Blackburnian Road spoke on behalf of his father, Joseph Thomas, an abutter of the same address, objecting to the clearing of brush on the property on the side facing Blackburnian Road and said that sounds emanating from the property were disruptive to the neighborhood. He said that his father had complained to the police about this and offered photographs for the record. The applicants contended that the cutting was done without their permission by representatives of the railway and that they have complained to the relevant authorities.
Mrs. Jean McKnight, 341 South Great Road, also objected to certain clearing and offered photographs for the record. It appeared that the photographs were taken of the property as it existed in 1997.
The Board determined that the record should remain open for reports from the Building Inspector and reports of site visits by members of the Board and any additional material to be submitted by applicants or interested parties. The matter was continued until March 1.

3) Alicia Southwell, 148 Weston Road, M/P 110 38 0, Applicant seeks special permit to construct additions to her existing single family home. Ms. Southwell has been living there for eight years, has two teenagers and is getting remarried to someone with two teenagers. With the additional family, there is a need for more space. Mr. Charles Letovsky, of Building Solutions, appeared with the applicant and will be handling the proposed remodel. The proposed additions will consist of a two story addition to the west side; on the east side a three story addition with the same footprint as the existing porch; on the south front a one story mudroom addition; and on the north back, a dormer with a shed roof added to existing gable (no increase of roof height) and also on the north back, a one
story addition extending the back of existing family room. It was noted that the height of the structure will remain unchanged. Mr. David O’Neill, 4 Moccasin Hill Drive, a neighbor, spoke of his support for this project. It was also noted that the existing screening and the natural vegetation will be maintained.

Administrative Matters:
a) BOA meeting minutes of 10/5/06 approved.
b) ZBA Permitting Guide page discussed: The edits of Joel Freedman, Pamela Green, and John Kimball will all be incorporated into final document. No other comments or edits were received.
c) Lincoln Public Safety Letter of Withdrawal for proposed Radio Tower Height increase distributed.
d) Rogers Decision regarding an accessory apartment signed.
e) March 1 ZBA meeting confirmed with all present BOA members (with the exception of Joel Freedman who needs to check his calendar).
f) Reminder to give potential nominees for the ZBA to the Selectmen.
