ZBA minutes Nov. 29, 2007
Minutes from the Zoning Board of Appeals Meeting of 11-29-07

The meeting was called to order at 7:40 pm in the Lower Level Conference Room at Town Offices.  Present: John Kimball, Chair, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle and Dorothy Blakeley, ZBA Clerk.  

New Matters:

Peter Sprayregen, 34 Baker Farm, M/P 42 4 0, for a special permit to install a 50 foot photovoltaic array system.  Mr. Sprayregen appeared with Dan Schmidt, a Walden Woods Project representative.  Walden Woods is the property directly affected by this potential installation.  Mr. Sprayregen looked into placing the solar array on the roof of his house, but found there would not be enough sunlight in that location.  The array would need both southern and eastern sun.  The board members reviewed the photos submitted by the applicant and discussed the possible locations within the property.  It was determined that the best location would be parallel to the property line while remaining 15 feet away from the corner.  Motion to close the record approved unanimously.
Action: Motion to approve this application approved unanimously.  Panel includes John Kimball, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle.  Jeff Macklin is the Decision writer.

Christopher Ridick, 9 Juniper Ridge Road, M/P 29 17 0, for a special permit for an accessory apartment.  Mr. Ridick bought this property 4 ½ years ago from Jane Barnet.  He has since renovated some of the interior of the house and plans to live in the accessory apartment while renting out the rest of the home.  There is parking for 5 cars and is Title 5 approved for 4 bedrooms and a garbage grinder.  Mr. Ridick noted the home has only 3 bedrooms.  The Planning Board has submitted a letter dated October 18th recommending approval of this accessory apartment and Mr. Ridick has also submitted letters of support from his neighbors.  Motion to close the record unanimously approved.
Action: Motion to approve this application, subject to the Board of Health approval, unanimously approved.   Panel includes John Kimball, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle.  Win Quayle is the Decision writer.

James DiGiovanni, 300 South Great Road, M/P 119 19 0, for renewal of a special permit to reconstruct a single family home.  The original Special Permit was granted on November 14, 2005.  Mr. DiGiovanni is unable to attend this meeting, but his representative, Mr. Thomas Falwell, Esq, of Comins and Newbury LLP, appeared on behalf of the applicant.  Mr. Falwell stated that this property has been on the market since 2005 when the initial special permit was granted.  Despite marketing efforts, the property remains unsold.  Mr. Falwell noted the applicant has approval from the Planning Board for renewal of the Site Plan.  Motion to close the record approved unanimously.  
Action:  Motion to approve this application approved unanimously.  Panel includes John Kimball, Anna Hardman, Joel Freedman, Jeff Macklin and Win Quayle.  Joel Freedman is the Decision writer.


Thomas Blakely, 144 and 146 Lincoln Road, M/P 95 13 3, for a special permit for parking in a B-1 district.  Mr. Blakely appeared with his attorney, Timothy Taylor.  Mr. Blakely purchased this building from Grace and Ernest Johnson and has an application to add a second story currently in front of the Planning Board.  The Planning Board requested that Mr. Blakely receive Zoning Board approval for parking.  A discussion of parking and possible number of tenants which may be housed in the building ensued between the Board members, Mr. Blakely and Mr. Taylor.  It was determined that the Board requires more information, specifically, square footage of the existing building as well as the proposed second story in order to determine the number of parking spaces needed.  
Action: This matter is continued until our next meeting on December 6, 2007.



Administrative:

David Segal, 39 Cambridge Turnpike, came in to informally talk with the Board about the possibility of purchasing and moving 2 or more of the buildings that are currently slated to be demolished at the Deaconess.  

Tracey’s Gas Station, 131 Cambridge Turnpike, James Lyons, representative, came in to informally inquire about the possibility of adding a store to the gas station.  It was the Board’s opinion that this was not a feasible option for this location under the zoning by-law.  

Accessory Apartment Discussion
The Board discussed the letter and policy created by John Kimball and the Board is in agreement with the letter and approach to revising our current procedures on renewal of accessory apartments.  It was decided that a fall renewal might be the best time for renewal process, since apartment leases often start and end at the beginning of an academic year.
